Washington Consumer Health Data Privacy Policy

This Washington Consumer Health Data Privacy Policy (“Consumer Health Data Policy”) applies to any personal information that (1) constitutes ‘consumer health data’ under Washington State’s My Health My Data Act (“MHMDA”) and (2) is collected from you by OS Health, LLC (“OS Health”, “we”, “our”, “us”) in connection with providing our movement guidance mobile application (including any related product integrations or APIs made available in connection therewith) (“Consumer Health Data”). This Consumer Health Data Policy does not apply to any sites, products, applications, platforms, or other services not directly linking to this policy.

The information in this Consumer Health Data Policy is provided to fulfill the requirements of the MHMDA, to the extent applicable. Unless otherwise defined below, capitalized terms used in this Consumer Health Data Policy will have the meanings provided in the Terms of Use and our Privacy Policy. In the event of a conflict between this Consumer Health Data Policy and any other terms effected between OS Health and you, this Consumer Health Data Policy will prevail to the extent required by applicable laws.

Information Regarding Your Consumer Health Data

As of the “Last Updated” date of this Consumer Health Data Policy, OS Health processes personal information that identifies the past, present, or future physical or mental health status of a consumer only in order to provide services in connection with its Service. As such, Consumer Health Data that we collect depends on the context of your interactions with OS Health, the choices you make (including your privacy settings and the information you choose to submit) in connection with the Service, and applicable law. In addition to the Personal Information described in the Privacy Policy, OS Health may process health- and fitness-related information that you voluntarily submit to the Service, such as information relating to injuries, pain, symptoms, physical limitations, fitness goals and activity history; behavioral and outcome information related to movement/exercise; and health-related information inferred or derived from user input and prior interactions (such as symptom severity, recurrence, attention level, and other health signals). Such health- and fitness-related information will generally fall into the following categories of Consumer Health Data:

Social, psychological, behavioral, and medical interventions;

Bodily functions, vital signs, symptoms, or measurements;

Diagnoses or diagnostic testing, treatment, or medication;

Data that identifies a consumer seeking health care services; and

Other information that is derived or extrapolated from nonhealth information which is associated with data in one of the categories above.

OS Health only collects, uses and discloses Consumer Health Data as needed to provide you with the Service that you request or with your consent.

Rights Regarding Your Consumer Health Data

Under Washington’s My Health My Data Act, residents of Washington State have the right (i) to confirm the specific categories of consumer health data about you that we are processing, and to access such data; (ii) to receive a list of all third parties and affiliates with whom we have shared or sold your consumer health data and an active email address or other online mechanism that you may use to contact these third parties; (iii) to withdraw consent from our collection and sharing of your consumer health data; and (iv) to have your consumer health data deleted upon request. Consumers may exercise any of these rights up to twice per year.

How to Exercise Your Rights

To exercise these rights, you may submit a verifiable consumer request to us by using the contact information provided at the bottom of this page. Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. Your verifiable consumer request must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with information if we cannot verify your identity or authority to make the request. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days from the day that we received your request), we will inform you of the reason and extension period in writing.

Exceptions

The above rights are not absolute, and in some instances, we may decline your request as permitted by law. If your request to exercise a right is denied, you may appeal that decision by contacting us at [email protected]. If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.

Note that some personal information is necessary to use our Service. As such, we may retain some of your personal information to comply with our legal obligations or as necessary to provide the Service.
